Terms of Service

Welcome to DukanList. These Terms of Service ("Terms") govern your use of dukanlist.com ("Platform") operated by DigiMutual Goals Pvt. Ltd. ("we", "us", "DukanList"). By accessing or using the Platform, you agree to these Terms. If you don't agree, please don't use the Platform.

DukanList is a free directory connecting local business owners in India with customers. We are an informational platform — we do not sell products, process payments between users, or transact on behalf of businesses listed.

You agree NOT to:

⚠ Violation consequences: Fake/abusive listings will be banned without notice. Repeated violations may result in IP blocking and legal action. Community flagging system auto-flags suspicious listings (3+ flags from different numbers).
📢 Important — Accuracy of Listing Information: Business owners are solely responsible for the accuracy of all information they list (business name, address, phone, hours, services, photos, prices, etc.). Submitting wrong, misleading, or impersonating information is a violation of the Information Technology Act, 2000 (Section 66D — impersonation) and may attract: You must update incorrect information within 7 days of becoming aware of it. DukanList is not liable for any harm caused by inaccurate business owner-provided data.

6. Content You Provide (User-Generated Content)

6.1 Ownership

You retain full ownership of all content you submit to DukanList — business info, photos, USP text, FAQs, reviews, Pucho Bhai questions and answers, and any other material ("Your Content"). DukanList does not claim ownership of Your Content.

6.2 License You Grant DukanList

By submitting Your Content, you grant DukanList a non-exclusive, royalty-free, worldwide, sublicensable license to host, store, reproduce, modify (for formatting/optimization only — not editorial), distribute, publicly display, and translate Your Content solely for the purpose of operating, improving, and promoting the Platform.

This license continues for as long as Your Content remains on the Platform and survives account closure only to the extent needed for backup, legal, and audit purposes (see Privacy Policy Section 7).

6.4 DukanList's Intellectual Property

The DukanList brand, logo, design, source code, database structure, AI-generated captions, default category icons, and platform-generated content (e.g., aggregate statistics, trust scores, leaderboards) are the exclusive property of DigiMutual Goals Pvt. Ltd. and protected under Indian and international copyright and trademark laws.

You may not copy, reverse-engineer, scrape, redistribute, or create derivative works of the Platform without prior written consent. Limited fair use (linking, sharing, embedding via official Share buttons) is permitted and encouraged.

6.5 Content Moderation

To maintain a safe and trustworthy environment, DukanList moderates user-generated content as follows:

💡 If your business information changes — for example, you move locations, change phone number, or update services — log into your owner dashboard and update within 7 days. Outdated information harms customer trust and may lead to your listing being de-ranked or removed.

7. Reviews

7.1 General review terms

7.5 Professional Listings — Additional Terms

If you register your listing under a regulated professional category, the following additional terms apply alongside (not in place of) the general Terms:

7.5.1 Compliance Mode (Strict Tier)

For listings flagged as strict tier (Chartered Accountant under ICAI; Doctor / Medical practitioner under NMC; Advocate under Bar Council of India; Company Secretary under ICSI; Cost Accountant under ICMAI) the following platform features are automatically disabled and you agree to and accept that:

7.5.2 Compliance Mode (Partial Tier)

For listings flagged as partial tier (Mutual Fund Distributor under AMFI; Stock Broker / Authorized Person under SEBI; Insurance Advisor under IRDAI; Financial Advisor), reviews and ratings remain available but the following apply:

By accepting the Professional Listing Compliance Disclaimer at registration (timestamped and recorded), you acknowledge that:

7.5.5 Limitation Specific to Professional Listings

DukanList is a directory platform, not your professional advisor and not your regulator. We are not responsible for whether your listing as configured satisfies every nuance of your regulator's rules — that responsibility remains yours. If your regulator finds any aspect of your DukanList listing non-compliant, you agree to notify DukanList promptly so we can adjust, but you cannot hold DukanList liable for regulatory action against you arising from your listing.

8. Lead Tracking

When you click "Call", "WhatsApp", "Directions", or "Share" on a business profile, that click is logged anonymously (IP-hashed, deduplicated per day) for the business owner's analytics. We do not share your phone number, IP, or identity with the business owner via lead tracking.

8.5 Mobile App Distribution

DukanList is available as an Android application on the Google Play Store ("App"), published by DigiMutual Goals Pvt. Ltd. The App is a Trusted Web Activity (TWA) wrapper around dukanlist.com — it loads the same content, with the same Terms and Privacy Policy, in a dedicated app shell.

DukanList may, in future, also be distributed via Apple App Store or other Android stores. The same Terms and Privacy Policy will continue to apply across all distribution channels.

9. Service Availability

DukanList is a directory platform, not a service provider. We:

Customers should exercise their own judgment when choosing services. Any contract is solely between the customer and the business — DukanList is not a party.

11. Limitation of Liability

To the maximum extent permitted by Indian law, DukanList, its directors, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to lost profits, lost data, or business disruption.

Our total liability for any claim shall not exceed ₹10,000 INR.

11.5 Indemnification

You agree to indemnify, defend, and hold harmless DukanList, DigiMutual Goals Pvt. Ltd., its directors, employees, agents, and partners from and against any third-party claims, demands, losses, damages, costs, expenses (including reasonable legal fees), and liabilities arising out of or related to:

This obligation survives the termination of your account. We will give you prompt notice of any claim and reasonable cooperation in the defense.

12. Termination & Account Deletion

12.1 Termination by You

You can permanently delete your DukanList account at any time, free of charge, directly from within the app:

12.2 Termination by DukanList

We may suspend or permanently terminate your access to the Platform without prior notice if:

12.3 Effect of Termination

We may update these Terms. Material changes will be announced on the homepage and via email/SMS to registered owners. Continued use after notice constitutes acceptance.
